Misdemeanor or Felony?

TheftIn most cases, if the goods you have stolen are under $300, you will only face a misdemeanor charge. But, there are instances where a person can face a felony when the item is only $100. Certain property types automatically qualify for a felony, such as stealing a fire extinguisher. While this product is well under the $300 threshold, it is a felony to remove these. Other times that can qualify for a felony conviction include:

  • A vehicle
  • Ammonia
  • A firearm
  • Farm animals
  • Stop signs
  • 2,000 or more pieces of fruit or produce

Shoplifting can also be charged as a felony if the value of the property is worth more than $300. While most shoplifting cases are handled by in-house loss prevention officers – especially if the thief is an employee – there are cases where they are turned over to the authorities.

You Need to Defend Your Rights

If you are charged with a felony, you could lose your rights and even face long prison sentences. Just some of the things that could occur if you are charged with a felony include:

  • Being unable to carry a firearm
  • Being unable to get a job
  • Losing your position in the military
  • Being unable to receive financial aid
  • Being unable to find housing
  • Losing your right to run for public office
