Misdemeanor or Felony?
In most cases, if the goods you have stolen are under $300, you will only face a misdemeanor charge. But, there are instances where a person can face a felony when the item is only $100. Certain property types automatically qualify for a felony, such as stealing a fire extinguisher. While this product is well under the $300 threshold, it is a felony to remove these. Other times that can qualify for a felony conviction include:
- A vehicle
- A firearm
- Farm animals
- Stop signs
- 2,000 or more pieces of fruit or produce
Shoplifting can also be charged as a felony if the value of the property is worth more than $300. While most shoplifting cases are handled by in-house loss prevention officers – especially if the thief is an employee – there are cases where they are turned over to the authorities.
You Need to Defend Your Rights
If you are charged with a felony, you could lose your rights and even face long prison sentences. Just some of the things that could occur if you are charged with a felony include:
- Being unable to carry a firearm
- Being unable to get a job
- Losing your position in the military
- Being unable to receive financial aid
- Being unable to find housing
- Losing your right to run for public office
There are defense to shoplifting and other theft crimes and whether or not you intended to truly steal, you need to protect your right. A criminal defense attorney can help disprove the prosecution’s case and possibly even reduce your sentence or have the charges dismissed altogether.
